Boot Camp Webinar – The Duty to Defend

November 15, 2019

In some instances, claims handlers and adjusters must decide if the insurer has a duty to defend a claim or if the claim falls outside of the coverage offered through the insurance policy. In some cases the decision may be clear, while in others, the duty to defend may fall in to a gray area. In either case, claims handlers and adjusters must be certain to take the correct steps to progress or close the file.

In this YRMC Boot Camp webinar, Kate Kozowyk of SVR Lawyers in Calgary, Caitlin Mahoney of Cox & Palmer in New Brunswick and Brian Murnaghan of CBM Lawyers in Edmonton provide new claims handlers and adjusters with a practical review of an insurer’s duty to defend and the steps to take when coverage is in question.

Topics covered include:

– The notice and investigation phase
– When and how to give notice in CGL, bodily injury and first party property claims
– The differences between provinces in documentary discovery
– Key issues to identify when dealing with a potential coverage issue
– Non-waivers or Reservation of Rights
– Triggering events that can lead to a waiver of an insurers duty to defend
– What to look for when reviewing the statement of claim
– Appointing coverage and defence counsel

The webinar concludes with a review of leading case law examples.

Recorded November 14, 2019.
