The Court granted the interlocutory injunction in respect to breach of fiduciary duties so as to prevent the respondent from soliciting or aiding in the solicitation of the applicant’s clients and soliciting the applicant’s employees until the disposition of the action. The Court was satisfied that the applicant had established a strong prima facie case that the respondent was in a fiduciary relationship with the applicant and the respondent had not met the obligations he owed to the applicant as a fiduciary employee. The Court was satisfied that the applicant established a strong prima facie case that the respondent actively solicited the applicant’s customers and/or used confidential information obtained while a director and officer of the applicants to the respondent’s own advantage.
