The insured was not required to disclose certain medical information due to the limited nature of the spectrum of information the insurance representative was attempting to collect. During a telephone conversation on November 17, 2009, Marylin Troy was asked if, since filling out the questionnaire one month prior, there had been any changes to the state of her health. More specifically, immediately after being asked a series of questions concerning a bone graft which took place in 2001, the insurance representative asked her if she had experienced a work-related accident, a work stoppage, a consultation with a physician, or any symptoms, to which she responded in the negative.
