The Court had to decide whether a person who was injured in a car accident and whose condition was aggravated due the subsequent fault of a third party can institute a civil liability remedy against the offending party.

The Facts

On January 10, 1999, Thérèse Godbout (“Godbout”) suffered multiple fractures to both of her legs in a car accident. Godbout had to have her legs amputated as a result of faults committed by medical personnel.
