Drivers: Do You Really Know Your Obligations in the Event of an Accident

The Highway Safety Code (the “HSC”) defines an “accident” as “an event in which damage is caused by a moving road vehicle.”¹

An incident will be considered an accident only if three conditions are met:

  1. It results in bodily injury or property damage;
  2. It involves a road vehicle;
  3. The road vehicle is in motion.

Under the HSC, the definition of a “road vehicle” is relatively narrow. It includes motor vehicles that can travel on a road, as well as trailers, semi-trailers and detachable axles. However, it excludes vehicles that operate exclusively on rails, power-assisted bicycles and electrically powered wheelchairs.
