Delev v. Sécurité nationale, compagnie d’assurances, 2016 QCCQ 8868
In two separate actions brought before the Court of Quebec, Small Claims Division, Mr. Gligor Delev (“Delev”) and Ms. Bertha Carillo (“Carillo”) each claimed $15,000 from their home insurer, Sécurité Nationale, compagnie d’assurances (“Sécurité Assurance”) for defence fees and amounts paid pursuant to a settlement reached with l’Association provinciale des constructeurs d’habitation du Québec inc. (“APCHQ”) which had sued them personally as the guarantors of a real estate project that turned sour, resulting in an obligation for it to pay large amounts.
