The Court had to decide whether Ski Bromont.com, société en commandite (“Ski Bromont”) should be considered liable for the damages suffered by Andrée-Anne Bergeron Girard (“Ms. Bergeron”) following a snowboarding accident she was involved in.

Ms. Bergeron had some 15 years of skiing and snowboarding experience. She purchased her equipment in 2010 and her snowboard edges had not been sharpened since, because she had only used the board around ten times.
