Roof Shingles Break and Fall Off – The Insurance Contract and the Insurer’s Obligation to Defend

The Court had to decide whether the insurer has an obligation to defend the insured in the context of a claim pertaining to the warranty surrounding the quality of materials used by the insured.

On August 14, 1995, Les Prêtres de Saint-Sulpice de Montréal (the “Priests”) signed a contract with Couverture Montréal-Nord ltée (“CMN”) to repair the roof of the Grand Séminaire de Montréal. In April of 2014, numerous shingles broke and fell off, causing material damage to the Priests, who instituted legal action against CMN and the insurance company, Compagnie d’Assurance AIG du Canada (“AIG”).
