In Branco v. American Home Assurance Company, Cameco Corporation, Kumtor Operating Company and Zurich Life Insurance Company of Canada Limited 2013 SKQB 98, the Plaintiff submitted claims for disability benefits to the Defendant insurers after suffering an injury to his foot while working at a mine in Kyrgystan. Finding that the insurers had discontinued benefits for inappropriate reasons and/or had failed to make payments in a prompt and reasonable manner, the Court held the insurers liable for breach of their duty of good faith and fair dealing. The Court awarded punitive damages of $4,500,000 and aggravated damages of $450,000.00. The Court of Appeal Rules in Saskatchewan provides that an appeal must be brought within 30 days after the date of the Judgment.
