A Home Goes up in Flames – False Statements Made at the Time of Enrolment – The Insurer Refusing to Pay

The Court had to decide whether the insurer has the right to deny compensation and cancel the insured’s insurance contract ab initio. On July 24, 2011, while he was absent, Jimmy Laporte’s (“Laporte”) entire residence was ravaged by a fire. Laporte’s neighbour’s son (“Nadeau”) noticed the fire around 4 am. He immediately called emergency services, which arrived on the scene around 25 minutes later. Upon arrival, the fire chief noticed that the fire was generalized. Despite the firefighters’ efforts, the building was a total loss.
